The Supreme Court of India has issued a clarification regarding its interim order that stayed the release of in-service women officers from the Indian Army. The Court confirmed that this stay applies to all women officers whose cases are currently pending in the Supreme Court, any High Court, or the Armed Forces Tribunal (AFT).
This clarification was made by a bench consisting of Justices Surya Kant and N. Kotiswar Singh. It came after Additional Solicitor General Aishwarya Bhati, representing the Union Government, mentioned the issue before the Court.
"The order dated 09.05.2025 is clarified to the effect that:
(i) The interim protection shall apply to all those officers whose matters are pending in the Supreme Court.
(ii) Such protection shall also cover those officers whose cases are sub judice before the Armed Forces Tribunal or the High Courts."
The Court also stated that the temporary arrangement will remain in place until the next hearing date. This continuation will be without affecting the rights of any party involved. The main matter is scheduled for hearing on August 6, 2025, and the Court has clearly stated that no adjournments will be allowed.

Earlier, on May 9, 2025, the Supreme Court had passed an interim order preventing the release of in-service women Army officers. The Court had stated:
"Without creating any equity in their favor, it is directed that all officers-in-service be not relieved till the next date."
Justice Surya Kant also acknowledged the commitment and efforts of the Indian Army, especially in light of recent security concerns following the Pahalgam Terror Attack. He emphasized that during such challenging times, every citizen must support the armed forces and help boost their morale.
The Court added that the final decision will be taken on the merits of the individual cases. However, in the meantime, the Army is free to utilize the services of these officers.
