On a relatively quiet afternoon in Court No. 14, the Supreme Court on Monday brought down the curtain on a civil dispute that had been lingering on its docket for some time. With little argument and no debate on merits, the Bench permitted the petitioners to withdraw the transferred case, effectively ending the proceedings before the top court. The order was brief, almost routine, but its impact was final.
Background
The matter involved Man Aaradhya Infraconstruction LLP and another, who had approached the Supreme Court in a transferred civil case against the Union of India and other authorities. Over the years, the case had travelled through procedural stages and was clubbed with a batch of connected matters listed on the same day.
When the case was taken up, counsel appearing for the petitioners informed the court that an interlocutory application had been filed seeking permission to withdraw the transferred case altogether. Such applications are usually moved when parties decide not to pursue the litigation further, sometimes due to settlement, change in circumstances, or simply because continuing no longer makes practical sense.
Court’s Observations
The Bench of Justice Manoj Misra and Justice Ujjal Bhuyan did not see any reason to keep the matter pending. Recording the request made by the Advocate-on-Record, the judges noted that the petitioners were no longer pressing the transferred case.
In its short order, the court made it clear that the request was voluntary and unambiguous. “The learned counsel prays that the transferred case be dismissed as withdrawn,” the Bench observed, before proceeding to accept the plea. There was no discussion on facts or legal issues, signalling that the court was consciously stepping away from examining the substance of the dispute.
The judges also clarified that once the main case was withdrawn, there was no purpose in keeping any related applications alive.
Decision
Allowing the interlocutory application, the Supreme Court formally dismissed Transferred Case (Civil) No. 85 of 2022 as withdrawn. The Bench further directed that all pending applications, if any, would stand disposed of automatically.
With this order, passed in New Delhi on December 9, 2025, the proceedings came to a close, leaving the court without having ruled on the underlying controversy between the parties.
