The Supreme Court Collegium has recommended the elevation of Justice Joymalya Bagchi, a judge at the Calcutta High Court, as a Judge of the Supreme Court. This proposal marks a significant step in the judicial landscape, as Justice Bagchi is poised to become the Chief Justice of India (CJI) in 2031.
The Collegium’s decision highlights the importance of representation from the Calcutta High Court in the Supreme Court. Notably, since the retirement of Justice Altamas Kabir as CJI on 18th July 2013, no judge from the Calcutta High Court has held the position of Chief Justice of India. Justice Bagchi’s elevation would address this gap and ensure broader representation from various High Courts across the country.
Justice Joymalya Bagchi is currently ranked 11th in the combined all-India seniority list of High Court Judges, including Chief Justices. His proposed elevation is based on his extensive experience and contributions to the judiciary. Once appointed, he will serve as a Supreme Court Judge for over six years before assuming the role of CJI.
According to the Collegium’s recommendation, Justice Bagchi is set to take office as Chief Justice of India following the retirement of Justice K.V. Viswanathan on 25th May 2031. His tenure as CJI will last until his retirement on 2nd October 2031. This development underscores the Collegium’s commitment to maintaining a balanced and diverse judiciary.
The Collegium also emphasized the current underrepresentation of judges from the Calcutta High Court in the Supreme Court. At present, only one judge from the Calcutta High Court serves on the Supreme Court Bench. Justice Bagchi’s elevation would not only address this imbalance but also bring a wealth of experience and expertise to the apex court.
