The Supreme Court of India has granted temporary bail to real estate developer Alok Kumar, accused in multiple fraud cases related to his company Agrani Homes. The top court directed that all 81 FIRs against him be clubbed together and treated as one consolidated case, while also laying down strict conditions for his release.
Background of the Case
Alok Kumar, a director of Agrani Homes, has been facing 81 FIRs filed by homebuyers who alleged that despite collecting more than ₹13.94 crore, their flats were never delivered. The first FIR was lodged on 11 January 2018 at Shastri Nagar Police Station, Patna, under Section 420 IPC and Section 138 NI Act. Since October 14, 2022, he has been in custody and secured bail in only 10 cases until now.

Earlier, the Patna High Court refused to club all the FIRs. However, the Supreme Court observed that keeping him in custody indefinitely would not help the homebuyers, who are already struggling to recover their money.
The Bench of Justice J.B. Pardiwala and Justice R. Mahadevan emphasized the interest of the homebuyers while passing the order.
“Keeping the petitioner in jail for an indefinite period of time is not going to serve any good purpose, so far as the interest of the home buyers is concerned,” the Court noted.

The judges directed that the first FIR of 2018 will be treated as the main FIR, while all other FIRs will be considered as statements under Section 161 CrPC, in line with the precedent set in Satinder Singh Bhasin v. State of U.P. (2023).
- The petitioner admitted a liability of ₹13.94 crore across all FIRs.
- He has already deposited ₹4 crore with the Court.
- The Court directed him to deposit an additional ₹9.94 crore within six months of his release.
- His son Shashwat also filed an affidavit, undertaking personal responsibility if his father fails to settle the dues.
- A list of properties owned by Alok Kumar and his companies was submitted to the Court, ensuring no transfer or sale without prior permission.

Bail Conditions
The Supreme Court granted Alok Kumar temporary bail for six months, subject to strict conditions:
- Deposit ₹9.94 crore with the Court Registry within six months.
- Furnish bail bond of ₹5 lakh with one solvent surety.
- Surrender his passport (currently held by RERA).
- Mark his presence at Shastri Nagar Police Station, Patna, once every fortnight.
- No transfer or third-party rights over his immovable properties without court permission.
The Court made it clear that depositing the amount will not be considered a final settlement, as the money must ultimately be distributed among the homebuyers.

The matter has been listed for 24 February 2026, when the Court will review compliance with its directions.
