A writ petition has been filed before the Supreme Court, demanding that Military Nursing Service (MNS) officers be recognized as "ex-servicemen" after retirement, along with all associated benefits. The petitioners argue that despite serving in the Indian Armed Forces, MNS officers are not granted the same recognition and benefits as other regular commissioned officers.

The case was presented before a bench comprising Justices Surya Kant and N Kotiswar Singh. Senior Advocate Dr. Adish Aggarwala, representing the petitioners, was informed that this petition would be heard alongside another related case, Union of India v. Maj. Gen (Mrs) Usha Sikdar.
The petitioners emphasize that they should be regarded as part of the regular army under the Army Act, 1950, and relevant regulations. They seek parity with regular commissioned officers in terms of benefits, both during their service and post-retirement.
"The petitioners argue that they are an integral part of the Indian Army and should be treated on par with regular commissioned officers," the plea states.

Furthermore, the petition demands the annulment of any orders, policies, or practices that deny MNS officers their rightful status as ex-servicemen or deprive them of benefits granted to regular officers. The petitioners have also requested that the authorities refrain from any punitive actions against them for filing this case.
The writ petition has been submitted through Advocate on Record (AoR) Amish Aggarwala.
"The petitioners should not face any punitive or retaliatory actions for exercising their legal rights by approaching the court," the plea adds.

The Supreme Court will now consider whether MNS officers, who serve the nation alongside regular officers, deserve the recognition and benefits they are claiming.
