The courtroom felt unusually attentive on Monday as the Supreme Court took up a cluster of writ petitions involving actor Shreyas Talpade, whose name has surfaced in multiple FIRs linked to alleged chit fund frauds across several states. While the allegations themselves are still under investigation, the Bench made it clear that personal liberty cannot be casually curtailed merely because a familiar face appears in an FIR.

Background

Talpade approached the court after being named in FIRs connected to the SAGA Group, which ran cooperative societies accused of luring villagers with promises of doubling investments within months. According to the petitions, his association with the group was limited to attending events as a guest celebrity and brand ambassador between 2018 and 2022.

As complaints mounted in states like Uttar Pradesh, Haryana, and Uttarakhand, the actor feared arrest in multiple jurisdictions for the same set of allegations. He sought consolidation of FIRs, protection from coercive action, and clarity on the scope of investigations.

Two other connected petitions were also heard. One involved a professional consultant and ex-banker accused due to advisory roles provided to cooperative societies, while another petition mirrored Talpade’s concerns over repeated FIRs stemming from the same alleged scam.

Court’s Observations

After hearing counsel for all sides, the Bench noted that, at this stage, the investigation was still ongoing and guilt or innocence could not be pre-judged. “The bench observed, ‘having regard to the nature of the role attributed and the stage of investigation, continued protection is warranted’,” one judge remarked in open court.

The judges stressed that arrest is not meant to be automatic. Where investigations can proceed without custodial steps, the law prefers restraint. At the same time, the court reminded petitioners that protection from arrest does not mean immunity from questioning. Cooperation with investigating agencies was described as non-negotiable.

Decision

In its final order, the Supreme Court continued its earlier interim directions, ordering that no coercive steps, including arrest, shall be taken against the petitioners until completion of the investigations in the listed FIRs. The court did not club or transfer the FIRs at this stage but allowed parallel investigations to continue. With these directions, all three writ petitions were disposed of. Pending applications were also closed.
