The Supreme Court on Tuesday (January 13, 2026) allowed a woman’s plea seeking transfer of a matrimonial case, shifting the divorce proceedings from Rajasthan to Haryana. The Court noted the inconvenience faced by the wife, who is caring for a minor child and residing far from the court where the case was originally filed.
Background of the Case
The case arose from a transfer petition filed by Roshi, seeking to move a divorce case initiated by her husband, Virender Singh. The original case-Petition No. 132 of 2024-was pending before the Additional District Judge No. 1 at Rajgarh in Churu district of Rajasthan.

Roshi informed the Court that she currently lives in Bhiwani, Haryana, along with her minor daughter. The distance between Bhiwani and Churu is over 146 kilometres, making repeated travel difficult. She also pointed out that two other related cases between the parties are already pending before courts in Bhiwani.
Court’s Observation
After hearing both sides, the Supreme Court found merit in the wife’s plea. The Bench, comprising Justice Rajesh Bindal and Justice Vijay Bishnoi, took note of the practical hardship involved.
“The petitioner has a minor daughter born from the wedlock and is residing at Bhiwani, Haryana,” the Court observed, adding that the long distance between the two places made regular court appearances burdensome for her.

The judges also considered the fact that related proceedings were already pending in Haryana, which would make it more convenient to hear all matters at one place.
Decision of the Court
Allowing the transfer petition, the Supreme Court directed that the divorce case be moved from the court at Rajgarh, Churu, to the Principal Judge, Family Court, Bhiwani, Haryana.
The Court ordered the Rajasthan court to promptly transmit all records to the transferee court. It further stated that if video conferencing facilities are available, the parties may be permitted to appear virtually on non-effective dates.

The Bench also suggested that, as far as possible, all cases between the parties should be listed on the same date before one court having jurisdiction.
With these directions, the transfer petition was allowed, and all pending applications were disposed of.
