In a case that unfolded from a late-night domestic confrontation, the Gujarat High Court closely examined whether a husband’s act leading to his wife’s death was driven by “grave and sudden provocation” or amounted to a more serious offence.
The judgment was delivered by Justice Gita Gopi on March 25, 2026, in a criminal appeal challenging a conviction under the Indian Penal Code.
Background of the Case
The appellant, Hasmukhbhai Bhurabhai Vasava, had earlier been convicted by a trial court under Section 304 Part-II IPC and sentenced to five years of rigorous imprisonment.
According to the prosecution, the incident dates back to the night of July 31, 1997. The accused claimed he discovered his wife in an intimate situation with a neighbour inside their home. What followed was a violent altercation.
The prosecution alleged that the accused assaulted his wife with fists, kicks, and a wooden object, causing multiple injuries that ultimately led to her death.

Defence Version
Counsel for the appellant argued that the incident was not premeditated. It was submitted that the accused acted under extreme emotional disturbance after witnessing his wife in a compromising situation.
“The act was a result of grave and sudden provocation, leading to loss of self-control,” the defence argued, urging the court to consider legal exceptions under Section 300 IPC.
