Calcutta High Court Orders Corrections in A.T. Goyee Enterprises vs Nand Lal Rathi Case

The Calcutta High Court, Commercial Division (Original Side), on 28th August 2025, issued an order directing several corrections in its earlier judgment dated 25th August 2025. The case involved A.T. Goyee Enterprises and Nand Lal Rathi, with cross-suits pending between the two parties.

Corrections Ordered by the Bench

Justice Sugato Majumdar, while hearing submissions from both sides, allowed rectifications in the cause title, names of advocates, and certain factual descriptions. The Court observed that accuracy in records is essential to avoid confusion in execution and further proceedings.

The corrections included changes in party names, advocate details, and textual modifications in the judgment. For instance, the defendant’s name in EOS/1/2010 was corrected to "M/s A.T. Goyee Enterprises and Ors." instead of the earlier spelling error. Similarly, the appearance of the plaintiff’s advocate was amended from "Mr. Joyjit Ganguly, Sr. Adv." to "Mr. Jayjit Ganguly, Adv."

The Court also directed factual corrections, such as replacing the word "building" with "basement", and revising the narrative regarding license fee payments. Justice Majumdar clarified that the record should reflect that,

"since October 2008, the partnership firm stopped accepting license fees from Mr. Rathi,” rather than the earlier version which incorrectly suggested that Mr. Rathi had stopped payments.

Importance of Accuracy in Court Records

Other significant corrections included rectifying names of individual - "Mr. Lal Mohan Chowrasia" to "Mr. Lalman Chowrasia", and “Smt. Sreema Sharma" to "Smt. Seema Sharma". Monetary figures were also amended, with a reference to Rs.10,000/- corrected to Rs.1,000/-.

Justice Majumdar emphasized the importance of precise language and correct records in judicial proceedings.

"Clarity in the judgment ensures that no party suffers due to typographical or clerical errors," the Court noted.

This rectification order highlights how even minor clerical errors in judgments can create confusion for litigants and advocates. By allowing these corrections, the Calcutta High Court reaffirmed its commitment to fairness and accuracy in legal records.

The matter now stands corrected, with the concerned department instructed to incorporate the changes in the judgment dated 25th August 2025.
