In a recent ruling, the Karnataka High Court allowed the burial of a migrant laborer who was allegedly killed in a police encounter. The laborer had been accused of killing a minor girl, and his death in police custody had sparked widespread controversy.

The incident involved a migrant worker from a neighboring state who was accused of the heinous crime. According to the police, the suspect was killed during an attempted escape while in custody. However, the circumstances surrounding the death raised questions, and there were calls for an independent inquiry.

The family of the deceased had requested the right to bury their loved one, but the authorities had initially withheld permission, citing ongoing investigations. The court, in its judgment, acknowledged the family's right to perform the burial rituals while ensuring that the investigation continued.

"The family has the right to perform the last rites of the deceased, and there is no legal provision preventing the burial while the investigation is ongoing," the court remarked. It emphasized the importance of respecting cultural and religious practices related to death and burial, stating that the legal process should not hinder these practices unnecessarily.

The court’s decision came after the police assured that the investigation would proceed without obstruction, and the case would be examined thoroughly to ascertain the truth behind the laborer's death. The court also emphasized that an independent probe would be conducted to ensure transparency and justice.

While the ruling has allowed the burial to proceed, the broader issue of police encounters and migrant laborers' rights remains a significant point of concern.
