Expressing concern over encroachments that obstruct natural water channels, the Rajasthan High Court has directed the State authorities to immediately clear illegal obstructions from nalas and catchment areas to ensure uninterrupted water flow during the monsoon. The Bench said protecting water bodies is essential for groundwater recharge in Rajasthan.
Background of the Case
The petition, filed by Govindram, highlighted alleged encroachments in Village Khatwada, Tehsil Sanganer, where permanent boundary walls and other constructions were said to be blocking water flowing towards the Nevta Dam. The Court noted that it had earlier taken judicial notice of similar issues affecting the Ramgarh Lake and Kukas Dam catchment areas.
The Division Bench observed that while landowners are entitled to demarcate their agricultural land, such demarcation should not obstruct natural watercourses.
The Bench observed,
"It is the responsibility of each citizen to see that the catchment area to the nearby water bodies should not be stopped by constructing pakka boundary walls."
The Court further noted that if boundary walls are necessary, adequate openings should be left at the lower end to allow rainwater to pass naturally. It also recorded that several natural nalas had been filled, disturbing the natural course of water.
Directing immediate action, the High Court ordered the State to remove all such obstructions and encroachments from nalas and catchment areas. The directions were extended beyond the present dispute to the entire catchment areas of Ramgarh and Kukas. The Court also restrained Civil and Revenue Courts from entertaining proceedings that could hinder the removal drive without its permission.
The Bench clarified that if landowners voluntarily provide access for water flow, the remaining portions of their properties should not be disturbed. The matter has been listed on 5 August 2026 for a compliance report.
