The Rajasthan High Court has declined to interfere with a State Government notification creating the revenue village “Khichan Vistar” in Phalodi district. The Court held that the decision was taken after considering relevant reports and administrative factors and did not warrant judicial intervention.
Background of the Case
The dispute arose after the State Government issued a notification creating Khichan Vistar as a separate revenue village. The petitioner challenged a later notification dated 13 December 2025, arguing that the village did not satisfy the prescribed distance criteria and that the decision had been reconsidered without any fresh material.
According to the petitioner, an earlier cancellation of the village's creation should have remained in force and the State could not revive the proposal through a fresh notification.
Court’s Observations
During the hearing, the State relied on official reports showing that the distance between the centre points of Khichan and Khichan Vistar was more than the required one kilometre. The reports recorded distances ranging from approximately one kilometre to over three kilometres through different routes.
Justice Sanjeet Purohit noted that the authorities had examined administrative convenience, territorial continuity, future development needs and local requirements before issuing the notification.
The Court observed,
“The decisive consideration is the distance between the centre points of revenue villages for examining the validity of creation of a new revenue village.”
The bench also found that the petitioner had not produced material to disprove the measurements recorded in the official reports.
Decision
The High Court held that the State Government possesses statutory power under the Rajasthan Land Revenue Act, 1956 to create, alter or reorganize villages through notification. It further found no legal bar preventing the State from issuing a fresh notification after reconsidering the matter.
Concluding that the creation of Khichan Vistar followed the prescribed procedure and that no ground for interference was made out, the Court dismissed the writ petition and upheld the notification dated 13 December 2025 creating the revenue village.
