The Supreme Court of India has ordered the transfer of a matrimonial case from Chennai to Kalyan, Maharashtra, accepting the plea of a wife who cited emotional distress and difficulty in travelling long distances to attend court hearings.

Background of the Case

The matter arose from a Transfer Petition filed by Subashini Pillai seeking the relocation of a divorce-related case filed by her husband, Velayutham. The original case, H.M.O.P. No. 4019 of 2022, was pending before the II Additional Principal Family Court in Chennai.

The petitioner told the court that she was facing trauma due to the respondent’s behaviour and was also struggling to travel frequently from Maharashtra to Tamil Nadu to contest the case.

Court’s Observations

A Bench comprising Justice Sanjay Karol and Justice Augustine George Masih considered the circumstances placed on record. The judges noted that the inconvenience faced by the wife was genuine and deserved consideration.

“The transfer can be allowed,” the bench observed while recording that the long distance and personal hardship justified shifting the proceedings.

Decision

Allowing the transfer petition, the Supreme Court directed that the case be moved from the Chennai Family Court to the Court of the Civil Judge, Senior Division, Kalyan, in Maharashtra.

The Court ordered that all records be sent to the transferee court without delay and instructed both parties to appear there on 25 February 2026. It also permitted the husband to attend the proceedings virtually unless his physical presence is specifically required.

All pending applications were disposed of along with the main petition.
