The parents of the trainee doctor who was allegedly raped and murdered at Kolkata’s RG Kar Medical College and Hospital in August 2024 have moved the Calcutta High Court. They are seeking an urgent hearing and permission for their legal counsel to visit the scene of the incident inside the hospital premises.
The plea was mentioned by senior advocate Phiroze Edulji before a bench of Justice Tirthankar Ghosh. The counsel urged the court to allow an early listing of the matter and grant him access to the location where the incident occurred, on behalf of the grieving family.
I seek urgent listing of this matter and permission to visit the crime scene, Edulji told the court, stressing the need for first-hand inspection.
However, the request for urgent hearing was denied at this stage.
"Serve notice to the counsel appearing for the CBI and then mention the matter," said Justice Tirthankar Ghosh, declining immediate listing.
The incident had caused nationwide outrage, prompting protests and a demand for justice. Initially handled by the West Bengal CID, the case was transferred to the Central Bureau of Investigation (CBI) after public pressure and legal intervention. The High Court had earlier taken suo motu cognizance of the matter and handed it over to the CBI through a Public Interest Litigation (PIL).
This case has shaken the conscience of society. The probe must be beyond reproach, the High Court had earlier observed while ordering the transfer.
The CBI, upon taking over the investigation, arrested Sanjoy Roy, the main accused in the rape and murder case. He was later sentenced to life imprisonment by the trial court following the filing of a chargesheet.
The case also reached the Supreme Court, which took suo moto cognizance and used the matter as an opportunity to formulate broader guidelines on ensuring safety for doctors, especially women, in workplace environments such as hospitals.

“The protection of doctors in their workplaces is a matter of urgent concern,” the apex court had remarked during its hearing.
Additional legal proceedings emerged when allegations of corruption and cover-up surfaced. The High Court directed the CBI to investigate former principal Sandip Ghosh, against whom accusations of shielding the crime surfaced. It was alleged that the Officer-in-Charge of the local police station, who had initially registered the FIR as an 'unnatural death', may have been in collusion with the principal.
However, due to the CBI's failure to file chargesheets in time, both the former principal and the police officer were granted bail.
At present, Sanjoy Roy remains the only person convicted in the case, having received a life sentence. The other cases, including those related to institutional lapses and alleged misconduct by public officials, remain pending as the investigation continues.
With the matter still live before the courts, the victim’s family is seeking a thorough and transparent investigation. Their fresh petition before the Calcutta High Court aims to strengthen their legal strategy by ensuring that their counsel can personally examine the crime scene.
