The Calcutta High Court recently took a serious stance on allegations of police brutality against students who were reportedly detained and assaulted in custody. During the hearing, Justice Tirthankar Ghosh made strong oral observations regarding the disturbing CCTV footage that had surfaced, showing the alleged assault.
The judge further emphasized that the practice of physically abusing detained individuals must be stopped. He observed:
"This happiness of thrashing persons arrested must be controlled... usually we don't get a case like this... candlestick was also there... holding the tuft of the hair. Full CCTV coverage was not given. Out of 17 hours of detention, only 13 hours was given."

The petitioners, who were student protestors, claimed that they were peacefully demonstrating outside their university premises when they were forcefully picked up by the police. They alleged that they were detained without any formal explanation and subjected to severe physical abuse inside the custody. According to them, they were tortured using candlewax, shoes, and belts, while being kept in unhygienic conditions. Furthermore, they were released in the middle of the night without any clarification regarding their arrest or detention.
The Advocate General, representing the state, sought an opportunity to review and circulate the report in order to present a defense on behalf of the police officers involved. However, the court raised concerns about whether such a report could be introduced at this stage of the proceedings.
Considering the gravity of the allegations and the evidence provided through CCTV footage, the court decided to list the matter for further hearing at a later date. The case is expected to unfold further as more details emerge regarding the conduct of the police officials and the response of the state authorities.
"I am expressing my mind... that police station is not well. You ask the DG to take steps. I may have to pass harsh orders. There are materials [on custodial torture]. I don't want to pronounce in open court, but issues of assault have surfaced in the CCTV. That's why I am telling you... this I can't allow. Irrespective of whether they are political opponents or students."
