In a deeply emotional and legally significant decision, the Kerala High Court has granted bail to a 91-year-old man who was accused of stabbing his 88-year-old wife. The incident reportedly occurred after a domestic dispute, where the elderly woman allegedly accused her husband of having illicit relationships with other women.
The accused, now granted bail, was booked under Sections 118(1) and 109(1) of the Bharatiya Nyaya Sanhita (BNS). The gravity of the incident and the age of both the individuals involved attracted significant attention from the court as well as the public.
While hearing the bail petition, Justice P.V. Kunhikrishnan delivered a heartfelt observation that added a compassionate layer to the legal proceedings. He noted the importance of companionship in the later stages of life and emphasized that both the husband and wife still hold emotional value for each other.
"A great marriage is not when the 'perfect couple' comes together, it is when imperfect couple learns to enjoy their differences," the Court remarked.
The Judge highlighted that despite the serious nature of the allegations, the emotional dynamics between the couple could not be overlooked.

“Thevan and Kunjali should know that age does not dim the light of love, it only makes it shine brighter,” he added, naming the elderly couple.
The Court further noted that the wife's continued concern for her husband, even after such an incident, is a reflection of enduring love that has stood the test of time.
"Kunjali, who is 88 years old, even now loves her husband and that is why she is closely watching her husband, who is aged 91. As we grow older, our love for each other deepens," said Justice Kunhikrishnan.

Considering the advanced age of the accused and the unique circumstances surrounding the case, the Court decided to allow him to be released on bail. The Judge observed that in the twilight years of life, it is only the spouse who remains as a companion and emotional support.
“In his old age, his wife will be his only strength,” the Court reminded the petitioner.
The bail was granted on the basis that reuniting the elderly couple could help them address their conflicts with mutual understanding and care, rather than continued legal isolation or punishment.
The judgment carries not just legal importance but also a touching reminder about human relationships and emotional bonds that often evolve with age. While the incident itself was unfortunate, the Court’s empathetic approach highlights how the justice system can blend law with humanity—especially in cases involving senior citizens navigating complex emotions in the final stages of life.
This case also brings attention to the often-overlooked mental and emotional strain the elderly face, especially in strained marriages or prolonged companionships that come under stress due to misunderstandings or miscommunication.
With the grant of bail, the Kerala High Court has taken a sensitive and thoughtful approach, balancing the need for justice with compassion and recognition of emotional intricacies that often surface in old age relationships.
