The Delhi High Court on Tuesday 20 January stepped in to protect the identity of Senior Advocate Vikas Pahwa after his photographs were allegedly misused online to cheat people and extract money.

Background of the Case

Vikas Pahwa approached the High Court claiming that several of his images were being circulated on social media platforms without his consent. According to him, these images were used by unknown individuals to deceive people and carry out financial fraud.

His counsel informed the court that the unauthorised use was noticed mainly on platforms like Facebook and Instagram, where fake profiles and posts were created using Pahwa’s photographs.

“These pictures are being used to defraud people,” Pahwa’s lawyer submitted during the hearing, adding that such misuse was harming the senior advocate’s reputation.

Court Observations

Justice Jyoti Singh heard the submissions and took note of the seriousness of identity misuse in the digital space. The court observed that a person’s name, image, and professional identity cannot be exploited for unlawful gains.

The bench indicated that protection was necessary to prevent further misuse of Pahwa’s identity and professional credentials.

Court’s Decision

Granting interim relief, the Delhi High Court restrained unnamed individuals and various social media entities from using Vikas Pahwa’s name, image, identity, or registration details without his consent.

Justice Singh also directed the takedown of the infringing content already available online.

“Granted,” the court said while allowing the plea and protecting the senior advocate’s identity from further misuse.
