The Patna High Court recently dismissed the anticipatory bail application of Photo Yadav, also known as Sanjay Kumar Yadav, in connection with Barari P.S. Case No.10/2025. The case involves serious allegations under Sections 109 and 3(5) of the B.N.S.S. and Section 27 of the Arms Act. Justice Satyavrat Verma delivered the order on August 11, 2025, after hearing arguments from both sides.
Background of the Case
The petitioner, Photo Yadav, feared arrest in a case registered at Barari Police Station. The informant alleged that her husband was attacked while purchasing vegetables. According to the complaint, accused individuals, including Photo Yadav, arrived on motorcycles. One of them, Manish, allegedly fired at the victim, causing chest injuries, while another, Phulan, fired indiscriminately.
Photo Yadav’s counsel argued that his client was falsely implicated. They emphasized that the informant was not an eyewitness and that no specific allegation of firing was made against Yadav. The counsel also pointed out that Yadav had been acquitted in four prior cases, though he had a criminal history.

The injured victim’s statement, recorded by the police, supported the prosecution’s case but did not accuse Yadav of firing. The victim stated that Manish shot him in the shoulder, Phulan fired randomly, and the accused fled while firing in the air.
State’s Opposition to Bail
The Additional Public Prosecutor (APP) opposed the bail plea, highlighting that the victim suffered firearm injuries. While Yadav was not accused of firing, the APP argued that his presence at the scene encouraged the main accused, Manish, to commit the crime. The state also stressed that the investigation was still in its early stages.

After considering the submissions, Justice Satyavrat Verma refused to grant anticipatory bail. The court noted Yadav’s presence during the incident and his failure to prevent the crime. The order stated:
"Considering the submissions made by the learned APP, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner."
The rejection underscores the court’s stance on individuals involved in serious crimes, particularly those with prior criminal records.
