The Punjab and Haryana High Court on Wednesday permitted the withdrawal of a criminal case linked to the Enforcement Directorate (ED), after the petitioner agreed not to pursue the matter further and undertook to deposit costs. The order was passed by Justice Aman Chaudhary while hearing a petition filed by Roop Bansal.

Background of the Case

The matter arose from a petition filed by Roop Bansal challenging proceedings connected to an FIR that had attracted action by the Enforcement Directorate. The case was listed as CRM-33261-2025 along with the main petition CRM-M-19843-2025 before the Punjab and Haryana High Court at Chandigarh.

During the hearing, the petitioner sought permission to withdraw the main case. The application for withdrawal was moved when the matter came up for consideration on January 22, 2026.

Senior advocates appearing for the petitioner informed the court that their client did not wish to press the challenge any further.

Court’s Observation

Justice Aman Chaudhary noted that the counsel for the petitioner made a clear statement before the court that no further challenge would be raised to the FIR in question.

The court also recorded that the State of Haryana and the Enforcement Directorate did not raise strong objections to the withdrawal request. However, the court considered it appropriate to impose costs in view of the stage at which the petition was being withdrawn.

“The learned counsel for the petitioner has stated, on instructions, that no further challenge shall be made to the FIR,” the court observed while recording the statement in its order.

The judge further noted that since the case had already engaged the court’s time, it would be just and proper to impose a monetary cost.

Court’s Decision

Allowing the application, the High Court formally dismissed the main petition as withdrawn. However, it made the withdrawal conditional.

The court directed the petitioner to deposit a cost of ₹1 lakh with the Haryana State Legal Services Authority within one week. It further ordered that proof of the deposit must be submitted before the court registry.

“Consequently, the main case is ordered to be dismissed as withdrawn, subject to deposit of costs by the petitioner,” the bench stated in its order.

With these directions, the proceedings were brought to a close.
