Rajasthan High Court Stays Installation of Dairy Booth in Bapu Nagar, Jaipur

The Rajasthan High Court at Jaipur has stayed the installation of a proposed dairy booth outside House No. B-173, Rajendra Marg, Bapu Nagar, Jaipur. The order was passed on 25 August 2025 by Justice Sameer Jain while hearing a writ petition filed by Ajay Shivpuri, son of Vijay Shankar Shivpuri.

The petitioner argued that the authorities permitted the installation of a dairy booth in front of his house without obtaining necessary No Objection Certificates (NOCs) from departments like Electricity, Police, and PWD. He submitted that the booth, once installed, would become a permanent structure and could be misused as a shop, wholesale kirana outlet, or even a small restaurant.

He further claimed that such unauthorized structures:

  • Cause nuisance in residential areas.
  • Affect the privacy and quality of life of residents.
  • Are being permitted across Jaipur without proper guidelines.

The Court noted that the petitioner had not impleaded important authorities such as PWD, local police, and the Electricity Department as parties to the case.

The Court also highlighted the wider public importance of the matter, as it relates to the violation of fundamental rights under Article 21 of the Constitution, connected with Section 152 of BNSS.

The judge observed:

“As per practice, such dairy booths often turn into wholesale kirana shops or small restaurants, creating larger public inconvenience.”

To examine the issue in detail, the Court appointed Mr. Ajay Pratap Singh as Court Commissioner. He has been directed to:

  • Inspect the Bapu Nagar area along with Gandhi Nagar and nearby localities.
  • Submit a report within seven days covering allotment, valuation, and commodities being sold at such dairies.

The Court directed Respondent Nos. 1 and 2 to pay ₹55,000 as fees and costs to the Court Commissioner. It also ordered the concerned police and authorities to extend full cooperation.

Until the next hearing, the High Court has stayed the installation of the proposed dairy booth outside House No. B-173, Rajendra Marg.

The petitioner’s counsel has also been asked to file an amended cause title by adding necessary parties. The matter will be heard again on 8 September 2025.
