The Bombay High Court has rejected a plea that challenged the election of Bharatiya Janata Party (BJP) legislator Captain R Tamil Selvan from the Sion-Koliwada constituency in the 2024 Maharashtra Assembly elections. The order was delivered on August 18 by Justice Milind Jadhav.
The petition had been filed by Congress candidate Ganesh Kumar Yadav, who lost the election to Selvan by 7,895 votes. Yadav alleged that Selvan failed to disclose his liabilities, including an arbitration award of ₹2.90 crores payable to the Indian Railways and a housing loan of ₹90 lakhs.

Justice Jadhav observed that the election petition lacked substance as it contained only vague and general allegations.
There is absolute non-compliance of the provisions of Section 83 of the Representation of People’s Act which require a concise statement of material facts and full particulars of corrupt practices, including names, dates and places, the judge noted.
The Court highlighted that Yadav failed to establish how these alleged omissions materially affected the election result.

The bench further clarified that the housing loan was in the name of Selvan’s daughter, while the arbitration award had already been stayed by the High Court.
"Once the Arbitration Award is stayed by the Competent Court in pending proceedings, non-disclosure of the same as liability of Respondent No.1 is not required," the judge stated.

It was also noted that the Returning Officer had already scrutinised Selvan’s nomination form, and no objections had been raised at that stage.
