Delhi High Court Orders Systematic Demolition and Rehabilitation of Madrasi Camp Dwellers Starting June 1

The Delhi High Court has directed the structured demolition of the Madrasi Camp in Jangpura, Delhi, beginning June 1, 2025, alongside comprehensive rehabilitation plans for eligible residents. The order was passed by a division bench of Justice Prathiba M. Singh and Justice Manmeet Pritam Singh Arora.

The Court observed that the camp was an unauthorised encroachment on public land, specifically along the Barapullah drain, which is crucial for drainage in the area. Its presence caused severe waterlogging during monsoon seasons.

"None of the dwellers can claim any rights beyond the right of rehabilitation, as the land is public land which is encroached upon," the Court stated.

A detailed survey conducted earlier found 370 jhuggis in the camp, with 189 residents qualifying for relocation under the 2015 JJ Policy. Despite multiple opportunities, many eligible residents did not collect their allotment letters.

To aid the transition, two camps will be organized between May 10 and May 12, 2025:

  • Camp 1: For distributing possession letters for flats in Narela.
  • Camp 2: For arranging loan facilities through bank representatives.

"The eligible persons/dwellers from the Madrasi Camp shall start moving their belongings to the respective flats allotted to them in Narela after 20th May, 2025," the Court directed.

Residents who ignore these provisions will not be given further chances for rehabilitation. For those left out of the earlier survey, a fresh one will be conducted on-site.

The Court also ensured that amenities in the Narela flats—including water, electricity, fixtures, transport access, schools, and health services—are available by May 20. DTC confirmed 38 bus routes operate nearby, and multiple schools and dispensaries are located within a 4.5 km radius.

"Timely clearance of the Barapullah drain is imperative to prevent severe waterlogging in the adjoining areas," the Court highlighted.

Although residents opposed shifting to Narela, the Court emphasized urgency due to the approaching monsoon season, affirming that it has been addressing this matter for over ten months. Claims of inadequate notice were dismissed, as demolition was already postponed since September 2024.

"Demolition was kept in abeyance during this entire period... most of the residents... participated in the Survey conducted for evaluating eligibility."

The Court confirmed that the demolition will proceed from June 1, 2025, and all belongings must be cleared by May 31. The responsibility to execute the relocation and demolition lies with DDA, MCD, DUSIB, PWD, and Delhi Government.
