Rajasthan High Court Issues Notice in Petition on Mental Health Curriculum and Counsellors in Schools and Colleges

In a significant step that could impact students across Rajasthan and beyond, the Rajasthan High Court at Jaipur issued notices to the Union of India, the state government, the University Grants Commission (UGC), and the Central Board of Secondary Education (CBSE). The case, filed by petitioner Sujeet Swami along with others, revolves around the pressing issue of psychological counselling and the inclusion of mental health education in school and college curriculums.

Background

The writ petition, registered as D.B. Civil Writ Petition No. 11889/2025, came up before a division bench comprising Justice Sanjeev Prakash Sharma and Justice Sanjeet Purohit. Petitioners, represented by advocate Vishal Kumar with his team, argued that the absence of structured mental health guidance in the education system is harming students.

With rising academic pressure, competitive exams, and the social challenges young people face, the petitioners pushed for an urgent framework where counselling and mental health education become mandatory.

On the other side, senior law officers appeared promptly. Additional Solicitor General R.D. Rastogi accepted notice for the Union of India, while Additional Advocate General S.S. Naruka represented the state. Advocates Dr. Abhinav Sharma and M.S. Raghav appeared for other respondents, including education boards and statutory bodies.

Court's Observations

The bench did not pass any immediate orders but made its intent clear. After hearing preliminary arguments, the judges directed that notices be issued to all concerned respondents. Importantly, they stressed that the government and regulatory bodies must come forward with concrete responses, not just vague assurances.

The order specifically records:

"Learned counsel for the respondents will be expected to file their suggestions and the steps which have been taken for providing psychological counsellors and also inform about the present steps being taken to incorporate subject of Psychological Maintenance and Mental Health in the subject curriculum at all levels."

By putting this on record, the court has effectively asked the Union, state, UGC, and CBSE to disclose what action has already been taken and what more is planned.

Decision

For now, the matter has been listed after eight weeks, giving time to the authorities to file their replies and present detailed action plans. The court’s decision to issue notices signals that it is treating the petition seriously.

If the directions evolve further, schools and colleges may soon have to ensure both dedicated counsellors and structured courses on mental health. For thousands of students struggling silently, this case could mark the beginning of long-awaited institutional support.
