The Rajasthan High Court at Jodhpur, while hearing a bail application filed by Kuldeep Singh, came down heavily on police officials for blatantly ignoring court summons and even arrest warrants. Justice Farjand Ali expressed strong displeasure on 28 August 2025, remarking that such defiance from law enforcers themselves erodes public faith in the justice delivery system.

Background

During the proceedings, the State’s counsel admitted that despite repeated attempts by the trial court to secure the presence of police witnesses - particularly those who played a role in recovery - they simply did not appear. Even warrants of arrest issued against them were not executed. This, the Court was told, had left the trial court helpless and the case at a standstill.

The Judge recalled that as far back as 2015, in the case of Ganesh Ram v. State of Rajasthan, the High Court had directed that each district must have a nodal officer, preferably a Circle Inspector, responsible for ensuring police witnesses attend court. Summons could be sent directly to such officers, who were to be held personally accountable for any lapse.

Court's Observations

Justice Ali minced no words while describing the situation.

"Nothing can be more shameful for a democratic system governed by rule of law," the bench observed,

Pointing out how astonishing it is that a serving police officer, despite an arrest warrant, continues to perform duties elsewhere without consequence.

The Court noted that failure to execute warrants against police officers creates a dangerous precedent and undermines public trust. It also highlighted that the directions from Ganesh Ram appeared to have been ignored, since even now no effective compliance was visible.

The order also quoted from earlier directions:

"The trial court concerned shall be authorized to directly forward the summons to such Nodal Officer who shall be responsible to effect service of the summons and ensure the attendance of the witnesses in the Court. In the event of non-compliance, the Nodal Officer shall be personally liable to face the consequences thereof."

Decision

In light of these lapses, the High Court has summoned an explanation from the Director General of Police (DGP), Rajasthan. The DGP has been directed to file an affidavit clarifying:

  • Whether the 2015 Ganesh Ram guidelines have been followed in letter and spirit.
  • The identity of the nodal officer in the concerned district during the relevant period.
  • Steps taken to ensure proper compliance with trial court orders.
  • Why contempt proceedings should not be initiated against responsible officers for disobedience.

The Court ordered that the affidavit be filed before the next hearing and fixed the matter for 12 September 2025. Justice Ali also directed the State’s Additional Advocate General to communicate the order to the DGP immediately.
