SC Flatly Refuses to Transfer NEET-UG 2025 Petition from Delhi High Court, Cites Individual Facts

On June 26, the Indian Supreme Court refused to transfer a petition related to the NEET-UG 2025 exam from the Delhi High Court to itself. The chief court held that the issue raised in the writ petition was based on individual facts related to the petitioner, and not on broader legal questions affecting all candidates.

Advocate Subhash Jha, counsel for the petitioner, argued that the prompts to be given to NEET candidates during the exam were not given, which affected his client's performance.

However, a bench of Justices KV Vishwanathan and NK Singh made it clear that such a fact-specific grievance should be dealt with by the respective high court.

"Your case depends on individual facts. We can transfer only if there are identical questions of law in the petitions pending in different high courts," - Justice KV Vishwanathan

The petitioner also urged the Supreme Court to transfer the case to avoid conflicting judgments by different high courts. However, the bench dismissed this concern, reiterating that the petition lacks common legal issues in several respects.

Further, the Supreme Court noted that the Delhi High Court has already listed the matter for hearing on July 31. Given the urgency - as the NEET-UG seats are expected to be filled by mid-July - the bench granted liberty to the petitioner to approach the Chief Justice of the Delhi High Court and request an early hearing.

Additionally, the Court was informed that the Madhya Pradesh High Court is currently hearing a similar plea regarding the power outage during the NEET-UG exam in Indore, which reportedly affected the performance of several candidates.
