In a brief but telling hearing on Thursday, the Supreme Court nudged the Government of India to move faster on long-delayed accessibility guidelines, which had been put on hold earlier this year. The bench, led by Justice Surya Kant and Justice Joymalya Bagchi, refrained from issuing strong directions but made it clear that the matter could not remain in limbo forever. For many in the courtroom - especially students with disabilities who had petitioned the court - the update felt like both relief and yet another wait.
Background
The dispute centers around government guidelines notified on 1 August 2025, aimed at improving accessibility and support systems for persons with disabilities, particularly in examinations and public institutions. However, barely a month later, the Centre suspended the guidelines through an Office Memorandum dated 10 September 2025, citing “unpreparedness to implement them in letter and spirit.”

The petitioners, led by Yash Dodani, argued that this suspension had left thousands of students uncertain about the upcoming exam cycle. Their counsel, Advocate Amar Jain, reminded the court that disabled candidates often plan months in advance and cannot adjust to last-minute policy swings.
Court’s Observations
During the hearing, Advocate Jain pointed the bench to the government’s own admission that infrastructure gaps, technical upgrades, and coordination with various departments were still pending. “The bench observed, ‘If the guidelines cannot be implemented immediately, the government must at least give a clear timeline. These transitions should not derail the rights of affected groups.’”

On the other side, Additional Solicitor General Archana Pathak Dave assured the court that preparations were underway and that the guidelines would be “reinforced along with requisite facilities” after 31 December 2025.
The bench seemed to accept the explanation for now but hinted that the government must stick to its new deadline. One judge remarked in passing - almost conversationally - that such matters “cannot go on endlessly,” prompting faint murmurs in the packed courtroom.
Decision
Concluding the session, the Supreme Court adjourned the matter and fixed 20 January 2026 as the next date of hearing. Until then, the court directed that the Bar Council of India may issue necessary circulars in line with decisions already taken. And with that brief but significant order, the bench rose for the day, leaving both lawyers and students hoping the coming months finally bring clarity.
