Tamil Nadu Government Moves SC to Transfer Plea Against ED Searches on TASMAC Offices from Madras High Court

The Tamil Nadu Government has filed a petition in the Supreme Court seeking the transfer of its case, currently pending before the Madras High Court, which challenges the Enforcement Directorate’s (ED) searches at TASMAC offices, to another High Court.

Senior Advocate Vikram Chaudhari, representing the State, mentioned the matter before Chief Justice of India Sanjiv Khanna, requesting urgent listing on Monday—prior to the scheduled hearing at the Madras High Court next week. He informed the court that the plea is filed under Article 139A of the Constitution, which allows the Supreme Court to transfer cases between High Courts. Chaudhari noted that an earlier petition filed by the State against the ED is already pending before the Supreme Court, raising various legal questions. He requested that the transfer plea be listed along with the pending matter.

The Chief Justice agreed to list the transfer plea.

The initial petitions by the State Government and TASMAC were listed before a Madras High Court bench comprising Justice M.S. Ramesh and Justice N. Senthilkumar. On March 20, the bench had orally asked the ED to pause its investigation after raising questions about the agency’s actions. However, during the next hearing, the same bench recused itself from the matter.

The case was then moved to another bench consisting of Justice S.M. Subramaniam and Justice K. Rajasekar, which has now scheduled the final hearing for April 8.
