Madras High Court Stresses Equal Access to Public Resources in Tenkasi Case

The Madurai Bench of the Madras High Court, in a recent order dated 26 August 2025, emphasized the importance of ensuring equal access to public resources, especially water facilities, without any discrimination. Justice Dr. R.N. Manjula made the observations while hearing a petition filed by Thirumalaisamy in connection with a criminal appeal.

Background of the Case

The petition was filed seeking suspension of sentence and bail in a criminal case (S.C. No. 281 of 2025) before the Principal District and Sessions Court, Tenkasi. While hearing the matter, the Court took note of wider issues concerning access to common resources and the role of authorities in upholding constitutional values of equality.

The Additional Public Prosecutor informed the Court that the Government of Tamil Nadu had issued a Government Order (G.O. Letter No. 6630/MA.3/2025-1, dated 25.08.2025) in compliance with earlier court directions. The Principal Secretary had circulated instructions to all District Collectors to strictly implement measures ensuring equal access to resources.

The Court recorded several important directions and commitments:

  • Equal Access to Resources: “Public resources must be accessible to everyone in the community without any discrimination,” the Court highlighted, directing the formation of monitoring committees.
  • Adequate Water Facilities: Authorities were instructed to ensure sufficient tap connections in all areas for fair and easy access to water.
  • Implementation of SC/ST Act Provisions: The Court stressed compliance with Section 21 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, particularly in the sharing of water.
  • Police Accountability: The Director General of Police has already circulated instructions to all senior officers to implement the Court’s orders without lapses.

The Court further observed that beyond government action, a change in mindset among people is crucial. It suggested replicating the Thalaivankottai Village model in Tenkasi District, where youth-led committees promote “Unity in Diversity.”

Justice Manjula remarked:
“Future citizens must learn how to achieve Unity in Diversity, which is a highly cherished constitutional aspiration.”
