The Supreme Court of India Registrar Court on Monday issued procedural directions in a civil appeal filed by Carzon Rent (India) Pvt. Ltd., asking the company to correct defects in an application seeking substitution of legal heirs of a deceased respondent.
The matter was heard before Registrar Mashroor Alam Khan, who also dealt with issues related to service of notice on several respondents and fixed the next date for further consideration.

Background of the Case
The proceedings arise out of Civil Appeal No. 10582 of 2024, filed by Carzon Rent (India) Pvt. Ltd. against Grandhi Bharatha Mallika Ratna Kumari and others.
During the hearing, the court noted that counter affidavits had already been filed on behalf of respondent numbers 1 to 4 and 6, while respondent number 13 was represented before the court. However, several other respondents had not appeared despite being served with notice.
The record also noted that respondent numbers 7 to 10 had not entered appearance even after service was complete, while respondent number 11 had already been deleted from the case by an order passed by the Judge-in-Chambers on February 28, 2025.
Issue Over Substitution Application
During the proceedings, the Registrar pointed out that the appellant had earlier filed I.A. No. 184973/2025 seeking substitution of the legal representatives of deceased respondent number 5.

However, instead of curing the defects pointed out in that application, the counsel for the appellant filed a fresh substitution application - I.A. No. 60088/2026 - which also contained defects.
The court directed the appellant’s counsel to remove the defects in the new substitution application by March 23, 2026, after which the application would be processed according to the rules.
Because of the filing of the new application, the earlier application for substitution was treated as infructuous, meaning it no longer required consideration.
Court’s Observation on Substituted Service
Another issue raised before the Registrar concerned an application seeking substituted service - a legal method used when direct service of notice on a party is not possible.
The court noted that the appellant’s counsel had not cured defects in the application for substituted service relating to respondent number 12, even though a last opportunity had already been granted on February 6, 2026.
During the hearing, counsel for the appellant informed the court that the defects would be rectified during the course of the same day.
The Registrar directed that if the defects are cured, the matter should be listed again before the Registrar Court on March 25, 2026. Otherwise, the case will be placed before the Judge-in-Chambers for further directions.

Proceedings in Connected Appeal
The Registrar also dealt with a connected matter, Civil Appeal No. 3631 of 2025, which is linked to the main dispute.
The court recorded that respondents 1, 3 to 5, and 8 were represented, while respondent number 2 had not appeared despite service of notice.
The order also clarified that respondent number 6 in the connected appeal corresponds to respondent number 11 in the main appeal, who had already been deleted from the proceedings earlier.
The appellant’s counsel was directed to file an affidavit along with proof of paper publication regarding service on respondent number 7 by March 23, 2026, describing it as the last opportunity.
If the affidavit and proof of publication are filed, the matter will also be listed before the Registrar Court on March 25, 2026. Otherwise, it will be placed before the Judge-in-Chambers for further directions.

Court’s Decision
The Registrar directed the appellant to remove defects in the substitution application and service-related filings by March 23, 2026, failing which the matters may be placed before the Judge-in-Chambers.
Both the main appeal and the connected appeal have been listed for further hearing before the Registrar Court on March 25, 2026, subject to compliance with the directions issued.
